Terms of Service

These Terms of Service ("Terms") govern your use of the Forge AI application and the website at fitdaily.app (together, the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using Forge, you represent that you are 18 or older and able to enter into these Terms.

2. The Service

Forge helps you log food and workouts, estimate calories and macros, generate training sessions, track weight and progress, and receive AI-assisted reviews. Core data is stored on your device. Some features rely on third-party services, including AI providers, public nutrition databases, Apple Health, Health Connect, analytics, and hosting services. We may add, change, or remove features at any time.

3. Your Data

The core Service does not require an account; your data is stored on your device. You are responsible for the information you enter and for safeguarding your device. Because data is stored locally, it may be lost if you clear storage, reinstall, or switch devices. Export your data from the Profile tab if you want to keep a copy.

4. Not Medical Advice

The Service does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional care. Consult a qualified medical professional before making changes to diet, exercise, medication, or treatment, especially if you have or may have a medical condition, injury, a history of disordered eating, are pregnant or nursing, are under 18, or take medication. If you think you may have a medical emergency, call your doctor or emergency services immediately. Never disregard professional medical advice or delay seeking it because of something in the Service.

5. AI Features and Limitations

AI-generated meal estimates, calorie and macro figures, workout plans, suggestions, and reviews are produced by automated systems and may be inaccurate, incomplete, or unsuitable for you. They are estimates, not guarantees or professional recommendations. You are responsible for reviewing AI output and exercising judgment before relying on it. Do not use the Service for emergency, clinical, or medically supervised nutrition or training needs.

6. Exercise and Nutrition Risk

Physical exercise and dietary change carry inherent risks, including injury or adverse health effects. By using the Service you voluntarily assume these risks. Calorie estimates, macro targets, weight goals, and workout recommendations are approximations. Stop exercising and seek help if you feel pain, dizziness, chest discomfort, faintness, or other unusual symptoms.

7. Free, Beta, and Paid Features

Forge is currently free during beta. We may later offer paid subscriptions or paid features. If we do, purchase terms will be shown before payment and may be handled through the Apple App Store, Google Play, or another payment processor. Free, beta, preview, or experimental features are provided "as is," may be changed or discontinued at any time, and may be less reliable.

8. Acceptable Use

You agree not to: copy, modify, reverse engineer, or attempt to extract source code, prompts, or underlying systems except where allowed by law; scrape or use automated means to abuse the Service or AI endpoints; resell or commercially exploit the Service without permission; bypass rate limits or security controls; submit unlawful or harmful content; or use the Service in violation of law or these Terms.

9. Intellectual Property

The Service, including its software, design, text, graphics, logos, and the Forge and FitDaily brands, is owned by us or our licensors and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal use, subject to these Terms.

10. Your Content and Feedback

You retain ownership of the content you enter. You grant us a limited license to process submitted content solely to operate and provide the Service. If you send feedback or suggestions, you allow us to use them without obligation to you.

11. Third-Party Services

The Service integrates third-party services, including AI providers, Open Food Facts, USDA FoodData Central, Apple Health, Google Health Connect, analytics, and hosting. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services or their results.

12. Disclaimer of Warranties

The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or that any estimate, plan, or result will be accurate or meet your goals.

13. Limitation of Liability

To the maximum extent permitted by law, Forge and its owners, employees, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, profits, revenue, goodwill, or personal injury or health consequences arising out of or related to your use of the service. Our total aggregate liability for claims relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Changes and Termination

You may stop using the Service at any time. We may suspend, change, or discontinue the Service at any time. We may update these Terms from time to time. The latest version will be posted here with an updated date, and continued use means you accept the updated Terms.
